Please read these Terms of Service carefully before using the Eleva Malta website or engaging our property management services. By accessing our website or entering into a management agreement with us, you agree to be bound by these terms.

1. Definitions

“Eleva Malta”, “we”, “us”, “our” refers to the property management company operating under the Eleva Malta brand in Malta.
“Owner” means the property owner who has engaged Eleva Malta to manage their short-let property.
“Guest” means any person who books or stays at a property managed by Eleva Malta.
“Platform” means the Eleva Malta website and any associated digital tools.
“OTA” means online travel agencies including Airbnb, Booking.com, and similar platforms.

2. Services

Eleva Malta provides short-let property management services including but not limited to: listing creation and optimisation, dynamic pricing, guest communication, check-in/check-out coordination, housekeeping management, MTA licensing assistance, and owner reporting.

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to affected owners.

3. Owner Obligations

As a property owner using our services, you agree to:

  • Ensure your property complies with all applicable Maltese laws, including obtaining and maintaining a valid Holiday Furnished Premises Licence from the Malta Tourism Authority (MTA).
  • Provide accurate property information, including any restrictions, house rules, and known defects.
  • Maintain the property to the standard agreed in your management agreement.
  • Notify us promptly of any changes affecting the property’s availability or condition.
  • Not list the same property on OTAs independently during the term of your management agreement without prior written consent.

4. Fees & Commission

Our management fee is agreed in your individual Owner Management Agreement. The standard Eleva Malta commission is calculated as a percentage of net revenue (gross booking revenue less OTA platform fees). Full details of applicable fees, payment schedules, and deductions are set out in your management agreement.

Owner payouts are made monthly in arrears. Eleva Malta reserves the right to deduct legitimate maintenance costs, cleaning fees, and other agreed expenses before remitting the owner’s share.

5. MTA Licensing & Regulatory Compliance

Eleva Malta assists owners in obtaining and renewing Malta Tourism Authority (MTA) Holiday Furnished Premises Licences. However, the legal obligation to hold a valid licence rests with the property owner. Eleva Malta accepts no liability for penalties, fines, or enforcement action arising from an owner’s failure to hold the required licence or comply with applicable regulations.

From 2026, all short-let properties in Malta are required to hold a valid MTA licence. Operating without a licence may result in fines of up to €5,000 per offence.

6. Intellectual Property

All content on the Eleva Malta website — including text, graphics, logos, images, and software — is the property of Eleva Malta and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

7. Disclaimers

The Eleva Malta website and revenue calculator are provided for informational purposes only. Projected income figures are estimates based on market data and are not guarantees of future revenue. Actual results will vary depending on property location, condition, seasonality, and market conditions.

To the fullest extent permitted by Maltese law, Eleva Malta excludes all warranties, express or implied, regarding the accuracy or completeness of information on this website.

8. Limitation of Liability

To the maximum extent permitted by law, Eleva Malta’s total liability to you for any claim arising out of or in connection with these terms or our services shall not exceed the total management fees paid by you in the three months preceding the claim.

Eleva Malta shall not be liable for any indirect, incidental, special, or consequential damages, including loss of income or profit, arising from your use of our services or website.

9. Indemnification

You agree to indemnify and hold harmless Eleva Malta, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from: your breach of these terms; your violation of any applicable law or regulation; or any claim by a third party relating to your property.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Malta. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Maltese courts.

11. Changes to These Terms

We may update these Terms of Service from time to time. The “Last updated” date at the top of this page reflects the most recent changes. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
